David applies 37-plus years of experience litigating, settling and teaching complex commercial litigation to helping litigants resolve their disputes.
In Mediations, he combines facilitative with evaluative techniques to help counsel and the parties resolve disputes, digging in deeply to learn the case, treating counsel and the parties with the utmost respect and searching for solutions based on carefully listening to and probing the parties and aided by many years of experience.
In Arbitrations, he treats all participants with respect, thoroughly learns his cases and is a good listener. Here as well, he applies a wealth of experience as a litigator, teacher and neutral under the relevant arbitration rules, applicable law and facts.
The same approach applies to the Special Master role, where he is available to resolve discovery or other disputes or to help settle large scale litigation. For example, as Special Master, he can help the parties resolve disputes over privileged documents without, in most cases, the trial judge having to review the subject documents. This removes burden from the trial judge while also insulating the judge in most cases from exposure to the substance of privileged documents.
David’s specialized expertise includes complex commercial litigation, insurance coverage disputes, insurer insolvency, securities, corporate governance, product liability and mass torts, contract and fraud claims. In his 37 years of law practice, he has had extensive experience across a variety of industries, including the financial services and insurance industries, beer, spirits and wine industries, automobile and motorcycle industries and the pharmaceutical industry.

David retired on December 31, 2015 from Simpson Thacher & Bartlett LLP, where he litigated complex civil cases and advised corporate, association and individual clients for 37 years from 1978-2015, 29 of those years as a partner and his last year as Of Counsel .
David teaches Complex Civil Litigation at Duke Law School, where he has taught since 2011. He will also be teaching at the University of Miami Law School beginning in 2017-2018.
He is a member of the Panel of Distinguished Neutrals of the Institute for Conflict Prevention and Resolution (CPR) and the Commercial Mediation and Arbitration Panel of Federal Arbitration Inc. (FedArb). He is also an ARIAS-US certified arbitrator.
David is a member of the American Law Institute (since 1991); the Board of Visitors of Duke Law School (Chair 2009-2014); the Board of MFY Legal Services, Inc.
(Chair 2000-2002) and chaired the Product Liability Committee of the New York City Bar Association (2005-2008). He served on the Executive Committee of UJA Federation-- Lawyers Division from 1995-2013. He has been admitted to the bars of New York, New Jersey, Washington, DC and numerous United States District Courts, Circuit Courts of Appeal and the Supreme Court.
He received his BA degree from Duke University, summa cum laude, in 1975. He received his JD from Duke Law School in 1978, where he served on the Duke Law Journal.
